General Terms and Conditions (GTCs)

These General Terms and Conditions (GTCs) govern the use of our website and all transactions, services, and agreements entered into with Reforestal OÜ (“The Company”). By accessing our website or engaging with our services, you agree to be bound by these terms.

If you do not accept these terms, you must not use our website or services.

1. Scope and Purpose

1.1. These GTCs apply to all services, products, and agreements offered by The Company, including but not limited to digital goods, leases, reforestation services, and other environmental or business initiatives.

1.2. These terms supplement specific agreements (e.g., the Nature Saving Contract). Where discrepancies arise, the specific agreement takes precedence.

2. Legal and Regulatory Compliance

2.1. The Company operates in compliance with global legal frameworks, including but not limited to:

European Union Consumer Rights Directive (2011/83/EU)

General Data Protection Regulation (GDPR)

US Federal Trade Commission (FTC) guidelines

International environmental, e-commerce, and data security standards

2.2. Our operations are also guided by ethical principles, such as the United Nations Sustainable Development Goals (SDGs), with a focus on:

Clean Water and Sanitation (Goal 6)

Decent Work and Economic Growth (Goal 8)

Climate Action (Goal 13)

Life on Land (Goal 15)

Partnerships for the Goals (Goal 17)

3.Use of Website and Services

3.1. The Company’s website is intended for personal and non-commercial use unless otherwise agreed upon.

3.2. Users agree not to misuse the website, including unauthorized data extraction, hacking, or other prohibited activities.

3.3. All purchases, agreements, and transactions made via the website are subject to these GTCs and applicable laws.

4. Environmental Compliance and Responsibility

4.1. The Company ensures all projects and activities comply with applicable environmental laws and regulations.

4.2. Before initiating projects, the Company conducts Environmental Impact Assessments (EIA) where required, ensuring biodiversity and sustainability goals are met.

4.3. Activities involving indigenous lands respect community rights, obtaining necessary permissions and protecting cultural heritage.

5. Contracts and Agreements

5.1. All contracts entered into by the Company are legally enforceable, transparent, and compliant with international, national, and local laws.

5.2. Clients are required to review and accept any additional terms specific to services or agreements (e.g., the Nature Saving Contract).

5.3. Contract terms and related obligations may be updated to reflect changes in applicable laws or regulations.

6. Payment, Refund, and Cancellation Policies

6.1. Payments: All payments are processed securely and comply with EU PSD2 regulations and US e-commerce security standards.

6.1.1. Failed Debit Transactions: In the event of a failed debit transaction, the customer will be charged a fee of €3.50 to cover the costs incurred by our bank. 

6.1.2. Rejected Debit Transactions: If a debit transaction is rejected by the customer, an additional fee of €15.00 will be charged.

6.2. Cooling-Off Period:

Clients in the EU have a 14-day right of withdrawal for eligible purchases under the Consumer Rights Directive (2011/83/EU).

Clients outside the EU are entitled to equivalent protections under their local laws, where applicable.

6.3. Exceptions: Refunds or cancellations may not be available for:

Services or goods that have already been customized, delivered, or consumed.

Digital goods where access has been granted.

6.4. Refund requests must be submitted via email at support@reforestal.al, with supporting documentation, within the allowed timeframe.

7. Intellectual Property Rights

7.1. The Company retains all rights to intellectual property, including but not limited to software, methodologies, content, and branding.

7.2. Unauthorized use, reproduction, or distribution of intellectual property is prohibited without prior written consent.

8. Data Protection and Privacy

8.1. The Company adheres to the General Data Protection Regulation (GDPR) and other global data protection laws to ensure client privacy.

8.2. Clients agree to the collection, processing, and storage of their data as outlined in the Privacy Policy.

8.3. Personal data will not be shared with third parties without explicit consent, except as required by law.

9. Incentives and Subsidies

9.1. While the Company evaluates incentives such as government subsidies, its business model operates independently of these.

9.2. Any subsidies or incentives received will be transparently reported, ensuring alignment with the Company’s ethical values and sustainability goals.

10. Dispute Resolution

10.1. Negotiation and Mediation:

In the event of disputes, clients must first engage in good-faith negotiations with The Company.

10.2. Jurisdiction and Governing Law:

Disputes arising under these GTCs will be governed by the laws of Estonia unless mandatory provisions of the client’s country of residence apply.

10.3. For EU-based clients, disputes may also be resolved via the European Online Dispute Resolution (ODR) platform at:

https://ec.europa.eu/consumers/odr/.

11. Severability Clause

11.1. If any provision of these GTCs is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11.2. Invalid provisions will be replaced by valid terms that best approximate the original intent.

12. Changes to These GTCs

12.1. The Company reserves the right to update these GTCs at any time.

12.2. Updates will be posted on the Company’s website and take effect upon publication. Clients are encouraged to review the GTCs periodically.

13. Audit, Monitoring, and Compliance

13.1. The Company conducts periodic audits to ensure compliance with applicable laws, ethical standards, and these GTCs.

13.2. Identified issues will be promptly addressed with corrective actions.
